AGN crisis latest: I am giving you 24 hours to leave, Emeka Ike tells Ibinabo

Nollywood Star, Emeka Ike has reacted to the reaction of Ibinabo Fiberesima, president of Actors Guild of Nigeria (AGN) that she would appeal the court judgment that sacked her as the Guild’s president on Monday.

According to Nigeriafilms the actor disclosed that he gives Ibinabo 24 hours to apologise to the guild and vacate her seat or face being dragged to court again for contempt. Speaking on the threat of appeal made by the seating president Emeka posits that she has no case and points out what it entails to effect an appeal.

“She has not appealed. Do you know what an appeal of a judgment means? The judgment was given on Monday and I ask, ‘has she received a copy of the judgment she wants to appeal at the moment? Don’t insult my integrity. Before you make any appeal, you have to write papers and take the papers to the right places and you make an appeal with that.

If you don’t have the judgment papers in your hand, how do you appeal it? And when you appeal, before you get the court’s attention, you must serve it, you must give a notice of it for at least 29 days in a newspaper. There are ways things are done logically on issues like this. It is not for you do things anyhow. This is a very sensitive case. You are dealing with an A-list person. Your mindset is your mindset, it should not affect the other.

I give her (Ibinabo) 24 hours to tender an apology to the guild, 24 hours for talking about appealing this case, if not, I will serve her court papers and her cohorts; I am not joking on this matter. I am not using thugs, I am not using OPC, I am not using any cult members, I am not using the police, I am applying the Nigerian justice system and that is the civilized way of doing things” he says

AGN CRISIS: My removal is a miscarriage of justice, says Ibinabo

The last is yet to be heard of the crisis rocking the Actors Guild of Nigeria, AGN, in recent times as the woman at the center of the matter, Ibinabo Fiberesima during the week stormed the Court of Appeal to challenge the Federal High Court ruling on Monday, which nullified the election that brought her into office for the second time as President of the guild. Justice James Tsoho who gave the ruling, said the election was conducted against court order and ordered all parties involved to maintain the status quo.

The suit was filed by one actor, St. Maradona Mikevine, who was the National Treasurer in the election that produced another popular actor, Emeka Ike, as AGN president. Mikevine, in his suit, argued that the election that brought Ibinabo into office was conducted in the face of a subsisting court order restraining the conduct of AGN election.

The popular actor also, urged the court to determine whether it was proper for an election to be conducted in the face of an order to the contrary, and whether anyone could parade himself or herself as AGN executive based on an election conducted against a court order. The suit that brought about the initial order was filed by Emeka Ike.

Ibinabo who insisted that she was not the one that conducted the election that produced her as AGN president but the AGN board itself, had stressed that Mikevine ought to have channelled his grievance with the election to the Electoral Committee set up the guild, and not the court. Meanwhile, in an appeal suit No: FHC/L/CS/734/13, and dated 17th of March, 2015, which was made available to WG, the sacked President of AGN, is seeking an order of the Court of Appeal, setting aside the decision of the lower court, which nullified her election.

She’s also praying the Court of Appeal among other things to dismiss or strike out this action in its entirety. According to the suit, Ibinabo is challenging the ruling on the ground that Justice James Tsoho erred in law in holding that the Plaintiff has the locus standi to bring this action at the Federal High Court. The former beauty queen is also faulting the trial Judge for proceeding to hear and granting reliefs against persons who are not party to the case instituted against her since 2011, by Emeka Ike.

In addition, she’s insinuating that Justice James Tsoho did not make any finding on the specific ultra vires action of the Defendants that entitled the Plaintiff to institute the case against her, since he was not a party to the suit number FHC/L/365/2011 which his action was founded among other grudges. “Take notice that the Defendant being dissatisfied with decision contained in the judgement of the Federal High Court dated, 16th of March, 2015, do hereby appeal to the Court of Appeal upon the grounds set out in paragraph 3 and will in the hearing of the appeal seek the reliefs set out in paragraph 4”, reads the suit. A date is yet to be fixed for the hearing of the appeal.

However, reacting to Ibinabo’s decision to seek redress in the Court of Appeal, Emeka maintains that she has no case as he points out what it entails to effect an appeal. Noting that the way forward for the guild is for Ibinabo to abide by the court order and vacate her office as the President of AGN. Ike had filed a suit on July 25, 2013 to contest the formation of an illegal government coined “National Unity,” to run the affairs of the AGN. The actor had sought an order of court, reviewing the 2007 Constitution of the guild, as it relates to the tenure of members of Board of Trustees.

Actors who are jubilating over Ibinabo’s removal

However, mixed-reactions have continued to trail the court verdict. While some Nollywood practitioners have started to drum up support for the Ibinabo-led AGN government, many others are jubilating over the removal of the former beauty queen as the President of AGN. One of the actors who are jubilating is MC Smith Ochendo who once dragged Ibinabo to court in 2013, to seek the interpretation of the court on whether the President of the Actors’ Guild of Nigeria, Ibinabo Fiberesima should hold the post or not, being as ex-convict.

Reacting to the ruling, Ochendu said, “justice has prevailed against all odds. “The Court of Law is not ruled by emotion. The truth must prevail at all time. The court ordered all parties involved to maintain the status quo, but the Board of Trustees of AGN went ahead and conducted the election, presenting Ibinabo as the President of the Guild. But today, justice has prevailed. I am on a movie set in Enugu and we are jubilating at the moment,” he echoed.

Also, writing on his Facebook page popular film director, Dickson Iroegbu said, “When I heard over the radio that the former President of the Actors Guild of Nigeria (AGN) had been sacked by the court, I quickly called my Rasta brethren McSmith Ochendo to affirmed the news – thereafter I called another brethren, now acting president, Chief Emeka Ike to salute his rugged and dogged commitment to the rule of law. I advised though, that this victory be celebrated by all Nollywoodians at home and abroad. May the face of Nollywood reclaim her pride of place again.

BREAKING: Court Declares Emeka Ike As AGN President, Dissolves BOT.

Chairman AGN Lagos chapter Don Pedro confirms Emeka Ike declaration as president by the Federal High Court sitting in Ikoyi, Lagos, speaking to Nipponcy Richard this morning "i was there in court as the judge made the rule against the past president Ibinabo Fiberesima ,stay tuned for  reaction"

A Federal High Court sitting in Ikoyi, Lagos, has declared popular actor, Emeka Ike, as the authentic president of Actors Guild of Nigeria (AGN).

In its judgement on Monday, March 16, 2015, the court held that the election that brought Ibinabo Fiberesima into office as the guild’s president violated an earlier court ruling, which ordered that a status quo be maintained.
Ibinabo was taken to court by St Maradona Mikevine in a suit challenging the election that ushered in the former beauty queen as the guild’s president.
St Maradona’s lawyer, Malcolm Omirhobo, who spoke with Nigeriafilms.com after the court judgement on Monday, noted that all their prayers to the court were answered.

The court also ruled that the BoT of AGN, headed by Prince Ifeanyi Dikeh, be dissolved as its tenure had long expired.

Meanwhile, Ibinabo has vowed to appeal the judgement. She confirmed this to Nigeriafilms.com when contacted after the Monday’s judgement.

It would be recalled that Emeka Ike took Segun Arinze to court over this matter, but after Segun Arinze ended his tenure, an election was conducted and he handed over the reins of the guild to Ibinabo, who was only re-elected for a second term in that last quarter of 2014.

I think the bane of the movie industry are the Nigerian politicians..Zeb Ejiro

Respected film maker/producer, Zeb Ejiro has opened up on why most Nollywood actors/actresses misbehave when the become famous. Speaking to Yes International Magazine, he said:

"See! There are a lot of people who never dreamt of being what they are today. Suddenly, they found themselves there. People are running after them. Ah! I need to see you, I need to see you and all that. They start seeing themselves above God. That’s where they get it wrong. The movie industry did not start with the stars that are there today. It started with others".

"  When we were talking, we mentioned a name – somebody you saw some days ago in Ikeja trekking or something. If somebody had told that person that at one time, this is how it’s gonna be, the person will not believe. Where they get it wrong is that they see themselves above God, they see themselves above the industry. People who suffered to make them who they are, they dump those people, they don’t respect them. You are doing something today, maybe a child’s naming ceremony, marriage or whatever, they don’t attend".

"They don’t come, they don’t need you anymore! Because the politicians are giving them so much money, the politicians are buying them cars; female politicians are buying the male stars cars, homes and what have you. The male politicians are buying the female ones whatever they want. So, suddenly, they don’t need the producer anymore. They can even make bigger movies than you now because one politician will give them N100 million and you are looking for N15 million to do a blockbuster".

" So, suddenly, they find out that they are bigger than you. Not just you; they are bigger than the industry. They start to equate themselves with God and forget that these politicians will only use you while you are the reigning star. They will flock around you for that period of time. Immediately somebody else springs up, they will dump you and go to that person".

" I know a lot of these stars that are now calling me to say Zeb, I heard you are doing something, you are not calling us. Why? Because they are not getting jobs anymore; they are not relevant anymore; the politicians are not giving them money anymore, because the politicians have now seen younger people that they are frolicking with. I think the bane of the movie industry are the Nigerian politicians". That’s the truth!
